Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Chamele and any related websites, applications, services, features, and content provided by DailyQZ, LLC ("DailyQZ," "we," "us," or "our").

By creating an account, accessing, or using Chamele, you agree to be bound by these Terms. If you do not agree, do not use Chamele.

You must be at least 13 years old to use Chamele.

2. Changes to the Service and Terms

We may modify these Terms or any aspect of Chamele at any time.

We may add, remove, suspend, discontinue, restrict, or modify features, content, functionality, rewards, rankings, virtual items, subscriptions, or services without liability.

Continued use of Chamele after updated Terms become effective constitutes acceptance of the revised Terms.

3. Accounts

You are responsible for:

• Maintaining the security of your account.
• Maintaining the confidentiality of your credentials.
• All activity occurring under your account.

You agree to provide accurate information and keep it reasonably current.

We may suspend, restrict, or terminate accounts at any time, with or without notice, for any reason or no reason.

4. User Content

"User Content" means any content you create, upload, submit, publish, generate, transmit, or otherwise make available through Chamele, including quizzes, topics, answers, comments, profile information, feedback, and other materials.

You retain ownership of your User Content, subject to the rights granted below.

License to DailyQZ

By providing User Content, you grant DailyQZ and its successors, assigns, affiliates, licensees, partners, and service providers a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to:

• Host
• Store
• Reproduce
• Modify
• Adapt
• Translate
• Reformat
• Publish
• Distribute
• Display
• Perform
• Analyze
• Index
• Train on
• Process
• Create derivative works from
• Commercialize
• License
• Sell
• Use

such User Content and any derivatives thereof for any lawful purpose, including operating, improving, promoting, advertising, marketing, researching, training artificial intelligence systems, developing products and services, and commercial purposes.

This license survives account deletion and termination to the extent permitted by applicable law.

Feedback

Any suggestions, ideas, improvements, recommendations, comments, or feedback you provide may be used by DailyQZ without restriction or compensation.

5. Artificial Intelligence and Generated Content

Chamele may use automated systems, recommendation systems, artificial intelligence, machine learning systems, or similar technologies.

Information, User Content, and usage data may be used to develop, train, evaluate, improve, and operate such systems.

Generated content may be inaccurate, incomplete, offensive, outdated, or incorrect.

You are responsible for evaluating any content before relying on it.

6. Acceptable Use

You agree not to:

• Violate applicable laws.
• Infringe intellectual property rights.
• Upload malicious code.
• Interfere with service operation.
• Attempt unauthorized access.
• Scrape or harvest user data.
• Use automated systems to access the service except as expressly permitted.
• Upload unlawful, defamatory, abusive, threatening, hateful, or fraudulent content.
• Impersonate any person or entity.

We may remove content or restrict access at our sole discretion.

7. Intellectual Property

Except for User Content, Chamele and all associated software, designs, trademarks, branding, interfaces, databases, rankings, systems, and content are owned by DailyQZ or its licensors.

No ownership rights are transferred to you.

8. Copyright Policy (DMCA)

We respect intellectual-property rights and expect users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and we remove or disable access to allegedly infringing material expeditiously upon receipt of a valid notice.

Reporting Infringement

If you believe content on Chamele infringes your copyright, send a notice to our designated agent:

Your notice must include:

• Your physical or electronic signature (or that of a person authorized to act for the copyright owner).
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing and information reasonably sufficient to locate it (for example, the topic or quiz name, username, or a link).
• Your name, address, telephone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Counter-Notice

If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the same address containing: your physical or electronic signature; identification of the removed material and its location before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed in error; your name, address, and telephone number; and consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which DailyQZ may be found) and to accepting service of process from the person who filed the original notice. We may restore the material in 10–14 business days unless the original claimant notifies us they have filed a court action.

Repeat Infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers, and we may remove any content at our discretion.

9. Public Content and Community Features

Certain content may be visible to other users.

We do not guarantee privacy for content you choose to make public.

We may feature, promote, recommend, distribute, modify, or showcase public content without compensation.

10. Purchases, Subscriptions, and Virtual Items

We may offer paid features, subscriptions, premium content, virtual items, virtual currency, or similar products.

Unless required by law:

• Purchases are non-refundable.
• Virtual items have no monetary value.
• Virtual items are licensed, not sold.
• We may modify or discontinue virtual items at any time.

App store terms may provide additional rights.

11. Advertising and Promotions

Chamele may display advertisements, sponsored content, promotions, affiliate content, recommendations, and commercial messages.

We may receive compensation relating to such content.

We make no representations regarding third-party products or services.

12. Third-Party Services

Chamele may integrate with or link to third-party services.

We do not control third-party services and are not responsible for their content, actions, availability, policies, or practices.

Your use of third-party services is governed by their terms.

13. Termination

We may suspend, restrict, disable, or terminate your access to Chamele at any time, with or without notice, for any reason or no reason.

Without limiting the foregoing, we terminate, in appropriate circumstances, the accounts of repeat copyright infringers as described in Section 8.

You may stop using Chamele at any time.

Sections intended to survive termination will survive termination.

14. Disclaimers

CHAMELE IS PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYQZ DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• AVAILABILITY
• SECURITY
• RELIABILITY

WE DO NOT GUARANTEE THAT CHAMELE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYQZ, ITS AFFILIATES, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO CHAMELE SHALL NOT EXCEED THE GREATER OF:

• ONE HUNDRED U.S. DOLLARS ($100), OR
• THE AMOUNT YOU PAID TO DAILYQZ DURING THE TWELVE MONTHS BEFORE THE CLAIM.

16. Indemnification

You agree to defend, indemnify, and hold harmless DailyQZ, its affiliates, officers, managers, members, employees, contractors, licensors, service providers, and partners from any claims, damages, liabilities, losses, costs, expenses, and attorneys' fees arising from:

• Your use of Chamele.
• Your User Content.
• Your violation of these Terms.
• Your violation of any law or third-party rights.

17. Dispute Resolution and Arbitration

To the fullest extent permitted by law, any dispute arising from or relating to these Terms or Chamele shall be resolved through binding individual arbitration.

You and DailyQZ waive any right to participate in a class action, class arbitration, or representative proceeding.

If a court determines that this class-action waiver is unenforceable, this arbitration provision shall be unenforceable only to that extent.

Nothing prevents either party from seeking injunctive relief relating to intellectual-property rights.

18. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

19. Assignment

DailyQZ may assign or transfer these Terms and any associated rights or obligations without restriction.

You may not assign your rights without our prior written consent.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in full force and effect.
